Tax Residence and Exceptional Circumstances: A Vital Clarification for UK Leavers
Whether you’re planning a move abroad or already living overseas, your UK tax residency status can have a huge impact on how much UK tax you pay—not just on income, but also on capital gains and inheritance.
And now, thanks to a recent Court of Appeal decision, there’s important new guidance on how “exceptional circumstances” may help you avoid being classed as UK resident, even if you go over the permitted number of days in the country.
📅 Understanding the Statutory Residence Test (SRT)
The Statutory Residence Test (SRT) sets a series of rules for deciding whether someone is UK tax resident in a given tax year. The test is based largely on:
-
Number of days spent in the UK
-
Whether the individual was UK resident in any of the previous 3 tax years
-
The number of “UK ties” you have (e.g. UK home, UK family, substantive work presence)
However, up to 60 days per tax year can be excluded if your presence in the UK was due to ‘exceptional circumstances’—until now, a somewhat grey area.
⚖️ Court Ruling: A Broader Definition of Exceptional
In a recent case, a woman was found to have exceeded her UK day limit by just 5 days. She argued that these days were spent in the UK because of a moral obligation to care for her alcoholic and depressed sister, who had two young children.
The Court of Appeal agreed with her, making several key clarifications:
-
Exceptional circumstances don’t need to be rare in society—just unusual for the individual’s personal situation.
-
The law does not require the individual to be physically or medically unable to leave the UK.
-
A compelling moral obligation, such as caring for vulnerable family members, can count.
-
Circumstances should be judged “in the round”—not in isolation.
This significantly broadens how exceptional circumstances can be interpreted, particularly for individuals dealing with family or humanitarian issues.
🧮 Why This Matters
If you’re trying to emigrate, or limit your UK exposure for tax purposes, your UK residency status will determine whether you owe:
-
UK Income Tax on your worldwide earnings
-
UK Capital Gains Tax on asset disposals
-
UK Inheritance Tax, under new rules from April 2025
Even a few extra days in the UK could shift your status—and your liabilities.
